These Terms of Service ("Terms") govern your access to and use of the Fortiori website at www.fortiori.io (the "Site"), operated by Fortiori LLC ("Fortiori," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Acceptance of Terms
By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are accessing the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Eligibility
The Site is intended for business and professional use by individuals who are at least 18 years old. By using the Site, you represent that you meet this requirement.
The Website and Our Services
Fortiori provides offensive-security consulting services, including penetration testing, adversary simulations, offensive security engineering, and security analytics. This Site is an informational and marketing resource and a way to contact us.
Using the Site, downloading materials, or submitting an inquiry does not create a consulting engagement, a client relationship, or any obligation on Fortiori to perform services. A consulting engagement arises only under a separate written agreement signed by both parties (see Engagement Agreements below).
Engagement Agreements
All consulting engagements are governed by a written master services agreement and/or statement of work ("Engagement Agreement") that defines the specific services, and that controls over these Terms with respect to those services. An Engagement Agreement typically defines:
- Scope of testing and authorized targets;
- Timeline, milestones, and deliverables;
- Pricing and payment terms;
- Rules of engagement and escalation procedures;
- Confidentiality and data-handling requirements.
Training and learning offerings provided through the Fortiori Institute are governed by the terms published on that service.
Acceptable Use
When using the Site, you agree to act lawfully and in good faith. You may not:
- Scrape, crawl, or harvest the Site, or access it through automated means beyond ordinary search-engine indexing;
- Interfere with, disrupt, or degrade the Site or the infrastructure that serves it, or attempt to circumvent its security or access controls;
- Perform security testing against the Site except as expressly permitted by our Security disclosure program;
- Use information, techniques, or materials obtained from the Site to access, attack, or test any system without authorization; or
- Reproduce, redistribute, or create derivative works from Site content except as permitted under Intellectual Property above.
Intellectual Property
All content on the Site — including text, graphics, logos, and software — is owned by Fortiori or its licensors and is protected by applicable intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your lawful, internal evaluation. You may not reproduce, distribute, or create derivative works from our content without our written permission.
Deliverables produced during an engagement (such as assessment reports and findings) are licensed to the client as specified in the applicable Engagement Agreement. Fortiori retains ownership of its proprietary methodologies, tools, and frameworks.
Confidentiality
We treat client information and engagement findings as strictly confidential. We will not disclose engagement details, findings, or client identity to third parties without your written consent, except as required by law. Specific confidentiality terms are defined in the applicable Engagement Agreement or mutual non-disclosure agreement.
Disclaimers
The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free. Information on the Site is provided for general and educational purposes and does not constitute professional security advice or a guarantee of any security outcome.
Limitation of Liability
To the maximum extent permitted by law, Fortiori shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or its content.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, fraud, or personal injury.
Indemnification
You agree to indemnify and hold Fortiori harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site or of engagement deliverables, your use of information or techniques obtained from us against any system without authorization, or your violation of any law or the rights of a third party.
Export Controls and Sanctions
You represent that you are not located in a country or territory subject to comprehensive U.S. sanctions and that you are not on any U.S. government restricted-party list (such as the OFAC Specially Designated Nationals list or the BIS Entity or Denied Persons lists). You agree to comply with all applicable export-control and sanctions laws, including the U.S. Export Administration Regulations (EAR) and regulations administered by OFAC, and not to use, export, or re-export any Fortiori materials or services in violation of those laws.
Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict-of-laws rules. You and Fortiori agree to attempt in good faith to resolve any dispute informally before pursuing formal proceedings. Subject to that, the state and federal courts located in the State of Ohio have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site, and you consent to that jurisdiction and venue. Nothing in this section limits any mandatory consumer rights available to you under the law of your country of residence.
Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated "last updated" date and, where appropriate, additional notice. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
Termination
We may suspend or terminate your access to the Site at any time, with or without notice, including for any violation of these Terms. The sections on intellectual property, disclaimers, limitation of liability, indemnification, export controls, and governing law survive termination.
General
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fortiori regarding your use of the Site, and do not supersede or modify any Engagement Agreement, which controls for its subject matter. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
